Terms of Use
Last updated: October 29, 2026
These Terms of Use ("Terms") are an agreement between you and Magn.Obvious Inc. ("we", "us" or "our") about your use of our mobile apps (each an "App"):
- CalorieFit AI
- costBookKeeper
Part A applies to every App. Part B adds rules for each App. By downloading, accessing or using an App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
Part A: Terms for all Apps
1. Who may use the Apps
You must be at least 13 years old (16 in the EEA and UK). If you are under the age of majority where you live, you may use an App only with the permission of a parent or guardian, who agrees to these Terms for you. If you use an App on behalf of an organization, you confirm you have authority to bind it to these Terms.
2. Changes to these Terms
We may change these Terms. If a change is material, we will give at least 30 days' notice in the App or by email before it takes effect. If you keep using the App after the change takes effect, you accept the new Terms. If you do not accept them, stop using the App and delete your account.
3. License
We give you a limited, non-exclusive, non-transferable, revocable license to download, install and use each App for your personal, non-commercial use on a device you own or control, under these Terms.
4. Your account
To use an App you may need an account. You agree to give accurate information, keep your sign-in details confidential, be responsible for activity under your account, and tell us right away about unauthorized use. You can delete your account inside the App at any time (see Part B).
5. Acceptable use
You agree not to:
- break any applicable law or regulation;
- infringe our rights or anyone else's intellectual property or privacy rights;
- harass, abuse, defame or discriminate against anyone;
- submit false or misleading information;
- upload or send malware or anything that harms the App, our servers or other users;
- collect or track other people's personal information;
- scrape, crawl or send spam or phishing messages through the App;
- circumvent or interfere with the App's security features;
- reverse engineer, decompile or try to extract the source code of the App, except where the law allows it; or
- use the App's output to train a competing AI model.
6. Your content
"Your Content" means what you enter or upload into an App, such as meal photos, food and exercise logs, expense details, notes and receipts. You keep all rights in Your Content and are responsible for it.
You give us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process and display Your Content only as needed to operate, secure and support the App and to provide the features you ask for (for example, sending a meal photo to an AI provider for analysis). This license ends when you delete the content or your account, except for backup and legal-retention periods described in the Privacy Policy. We do not sell Your Content.
You agree not to upload content that is unlawful, defamatory, obscene, harassing, or that infringes anyone's rights, or that contains other people's private information (such as their government ID numbers or payment card numbers) without their permission.
7. Purchases
- Store purchases. Purchases are made through the Apple App Store or Google Play, and their terms apply. We do not receive your card details.
- Prices. Prices are shown in the App before you buy and may change for future purchases. Taxes may be added.
- Refunds. Apple and Google handle refunds under their policies. Purchases are otherwise final, except where the law gives you a right to a refund.
- Subscriptions (if an App offers one). A subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You manage and cancel it in your Apple or Google account settings. Deleting an App or an account does not cancel a subscription.
- App-specific rules for credits and other items are in Part B.
8. Apple and Google
If you downloaded the App from the Apple App Store, these Terms are between you and us only, not Apple. Apple's Licensed Application End User License Agreement also applies to your use of the App, Apple has no duty to provide maintenance or support for it, and Apple and its subsidiaries are third-party beneficiaries of these Terms who may enforce them against you. If you downloaded the App from Google Play, Google Play's terms apply to your download and purchases, and Google is not responsible for the App.
9. Third-party services
The Apps rely on third-party services such as AI providers, cloud hosting and app stores, and may link to third-party websites. We do not control them and are not responsible for their content or practices. Their own terms apply to your use of them.
10. Intellectual property
The Apps, their names, logos, design and features belong to us or our licensors and are protected by Canadian and international law. You may not use our names or trademarks without our written permission.
11. Disclaimers
THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT AN APP WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ITS RESULTS WILL BE ACCURATE OR MEET YOUR NEEDS.
12. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, MAGN.OBVIOUS INC. AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE AN APP, ANY THIRD-PARTY CONDUCT OR CONTENT, OR UNAUTHORIZED ACCESS TO YOUR CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US THROUGH THE APP IN THE 12 MONTHS BEFORE THE CLAIM AND CAD $100.
Nothing in these Terms limits liability that cannot be limited by law, or any consumer rights you have under mandatory law where you live.
13. Termination
You may stop using an App and delete your account at any time. We may suspend or end your access if you break these Terms, if the law requires it, or if we stop offering the App. Where practical, we will tell you first. When your access ends, your license to use the App ends. Sections that by their nature should continue (such as 6, 10, 11, 12 and 14) will continue.
14. Governing law and disputes
These Terms are governed by the laws of Ontario, Canada, and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Please contact us first so we can try to resolve any dispute informally. If we cannot, the dispute will be finally settled by arbitration administered by the Canadian Arbitration Association under its rules, in Toronto, Ontario. Nothing in this section removes rights you have under consumer protection law that cannot be waived, or stops either of us from going to court for urgent relief or small-claims matters.
To the extent permitted by law, you and we each agree to bring claims only in an individual capacity and not as part of a class or representative action. This does not apply where the law of your place of residence does not allow it.
If a court finds part of these Terms invalid, the rest stays in effect. Our not enforcing a right is not a waiver of it. These Terms and the Privacy Policy are our whole agreement with you about the Apps.
15. Contact
Questions about these Terms: magn.obvious@gmail.com.
Part B1: CalorieFit AI
Estimates only, not medical advice
CalorieFit AI uses AI to estimate calories and nutrients from photos and descriptions. The results are estimates and can be wrong. The App is for general wellness only. It is not a medical device, and it does not diagnose, treat or prevent any condition or provide medical, nutrition or dietary advice.
- Do not rely on the App for allergies, intolerances, diabetes management or any other medical or dietary decision.
- Talk to a doctor or registered dietitian before you change your diet or exercise routine, especially if you are pregnant, have a medical condition, or have or may have an eating disorder.
- In an emergency, contact your local emergency services.
You are responsible for reviewing and correcting results before you use them. Goals and targets shown in the App are suggestions based on what you enter.
AI processing
When you ask for an analysis, your photo or text is sent to an AI service provider as described in the Privacy Policy. By accepting the AI notice in the App you agree to this. If you decline, you can still enter food by hand.
Credits
- AI analysis uses credits. You buy credit packs inside the App as one-time purchases. They are not subscriptions and do not renew.
- Credits belong to your account, have no cash value, cannot be transferred, sold or exchanged, and are used for AI analysis in CalorieFit AI only.
- A credit is used when an analysis is requested. If an analysis fails because of an error on our side, we will restore the credit.
- Credits do not expire while your account is active.
- Unused credits are lost when an account is deleted or ended for a breach of these Terms.
- Refunds follow section 7 of Part A.
Deleting your account
Open Settings → Delete Account in the App and confirm.
Part B2: costBookKeeper
Record-keeping tool, not professional advice
costBookKeeper helps you record and organize your own costs and expenses. It does not give accounting, tax, financial or legal advice. You are responsible for the accuracy and completeness of your records and for any tax or other filings you make using them. Check them with a qualified professional where needed.
Your records and backups
We take reasonable care to store your records, but you should keep your own copies of important documents, including original receipts.
Purchases
If costBookKeeper offers a paid plan or purchase, section 7 of Part A applies to it.
Deleting your account
Open Settings → ManageData → Remove Account in the App and confirm.
